%X The State Ministries of the Republic of Indonesia are government institutions that are directly responsible to the President. Each ministry has the main task of implementing government policies and programs in certain fields and is able to contribute to the growth and development of the country. In order to facilitate the President in compiling the organization of state ministries that will assist him in organizing government affairs and in realizing an effective and efficient presidential government system with an emphasis on improving excellent public services, Law Number 39 of 2008 concerning State Ministries was formed which, along with the increasing complexity of issues and problems faced by the country, requires adjustments to the government structure to make it more responsive and effective. One form of adjustment is the addition of state ministries which is considered a strategic step to increase the capacity and performance of the government. Therefore, the Draft Law on Amendments to Law No. 39 of 2008 concerning State Ministries was passed into Law No. 61 of 2024. Researchers try to analyze how efficient and effective the addition of ministerial institutions is when viewed using the theory of state institutions and the concept of fiqh al-wizarah.
This research is a library research and is descriptive-analytical in nature using normative analysis in examining regulations related to research legal issues. Based on primary legal material data sources, the 1945 Constitution, Law Number 61 of 2024 concerning amendments to Law Number 39 of 2008 concerning the Ministry of State and secondary legal materials collected from legal literature and academic journals. The theoretical framework used includes state institutions and fiqh al-wizarah as an analytical tool to find answers to the research.
The research results show that increasing the number of ministerial institutions must consider the effectiveness and efficiency of government performance. The existence of ministries as state institutions must be directed to achieve government goals effectively and provide efficient public services for the welfare of the community. Viewed from the concept of fiqh al-wizarah, increasing the number of ministerial institutions in the Islamic government system must be based on the real needs of society so that the goal of increasing the number of ministers can increase the effectiveness of the government in serving the community and can increase the efficiency of the use of public resources.
