abstract: The phenomenon of withdrawal of support by political parties for regional head candidate pairs that have been registered with the General Elections Commission (KPU) raises serious problems in organizing general elections. In the context of the East Lampung regional head election in 2024, the unilateral withdrawal of support after the registration process raises legal issues and political ethics that have an impact on the political rights of candidates and political stability and democracy. This incident shows that political parties as pillars of democracy have not been fully consistent in carrying out institutional functions responsibly in accordance with the principles of popular sovereignty.
This research uses a normative juridical method with a legislative approach and analysis using the theory of democracy and Maṣlaḥah Mursalah rules. The data used are primary and secondary data from laws and regulations, press channels, and scientific literature. The purpose of this study is to examine the legality and impact of withdrawing political party support for candidate pairs that have met the administrative requirements and are validly registered. The main focus lies on the juridical and socio-political consequences of such actions and their relevance in maintaining electoral justice and democratic stability.
The results show that the withdrawal of support without a valid procedure not only disrupts legal certainty, but also undermines the principle of equal rights in a democracy. In addition, this action contradicts the values of justice and benefit in Islam as contained in the concept of Maṣlaḥah Mursalah. The withdrawal of support does not meet the criteria of objective benefit, does not prioritize the public interest, and has the potential to cause greater mafsadah than maslahat. Therefore, the actions of these political parties are considered incompatible with the principles of constitutional democracy and the principles of justice in Islamic law.
