"Interfaith marriage is still a hotly discussed issue in Indonesia due to the lack of\r\nlegal certainty and the absence of clear regulations in Law Number 1 of 1974\r\nconcerning Marriage. To provide clearer guidelines for the judiciary in handling\r\nsuch cases, the Supreme Court issued Supreme Court Circular Letter (SEMA) No.\r\n2 of 2023 which emphasizes the prohibition for District Court judges to grant\r\napplications for registration of interfaith marriages. However, after the issuance of\r\nthe SEMA, the North Jakarta District Court still granted the application for\r\nregistration of interfaith marriages in Determination Number 423/Pdt.P/2023/PN\r\nJkt.Utr. This situation raises questions regarding the judge's basis for considering\r\nthe ruling, its compliance with Indonesian positive law, and how the judge should\r\ndetermine similar requests in the future.\r\nThis research uses a normative juridical research method with analytical\r\ndescriptive research specifications. The research data was obtained through a\r\nliterature study which included primary legal materials such as statutory\r\nregulations, Supreme Court Circulars, and court decisions, as well as secondary\r\nlegal materials in the form of legal books and journals. Data analysis was carried\r\nout qualitatively by interpreting legal provisions relevant to the problems studied.\r\nThe results of the study show that the panel of judges in granting Decision\r\nNumber 423/Pdt.P/2023/PN Jkt.Utr referred to the legal basis in the form of\r\narticles in statutory regulations, but had not yet applied the judicial guidelines as\r\nregulated in SEMA No. 2 of 2023. In his considerations, the judge considered that\r\nCatholics and Protestant Christians were of the same faith so it was not considered\r\nan interfaith marriage.
