abstract: Murabahah
financing disputes have become cases that always arise in the
Religious Court, this dispute is related to the inability of customers to fulfill
payment obligations, claims that the agreement made is unfair, or the existence of
terms of the agreement by the party that are considered detrimental to customers.
In the decision of the District Court, it can be seen in Decision No. 26 / PDT.G /
2015 / PN.Jkt.Sel which will be the focus of the problem.
This study uses a normative legal approach, the source of this research
used in this study is jurisprudence. The method used in the study is library research
with an approach to primary legal materials and secondary legal materials.
The results
of this study are in the Decision of the District Court Number
26 / PDT.G / 2015 / PN.Jkt.Sel with the Murabahah dispute regulated in Article 55
of Law Number 21 of 200 8 concerning Sharia Banking including the Murabahah
contract resolved by the Religious Court. The Religious Court's decision must be
resolved in the Religious Court and cannot be resolved in the District Court if there
are no valid legal facts. The decision is analyzed using the principles of justice,
legal certainty, and legal benefits.
