abstract: The circulation of alcoholic beverages in the community has the potential to negatively impact health, morality, and public order. Bantul Regency Regional Regulation Number 4 of 2019 concerning the Control and Supervision of Alcoholic Beverages and the Prohibition of Mixed Beverages aims to protect the public from the negative impacts of alcoholic beverages and prevent the circulation of mixed beverages, which can cause serious harm. However, the rise in crime and social problems resulting from the circulation of alcoholic beverages prompted the issuance of Governor’s Instruction Number 5 of 2024 concerning the Optimization of Control and Supervision of Alcoholic Beverages, which serves as an additional reference for the regional government in tightening control and supervision. Therefore the question arises, how effective is Bantul Regency Regional Regulation Number 4 of 2019 concerning the Control and Supervision of Alcoholic Beverages and the Prohibition of Mixed Beverages following the issuance of Governor’s Instruction Number 5 of 2024 concerning the Optimization of Control and Supervision of Alcoholic Beverages.
This research is an empirical legal study using an empirical juridical research approach. It examines the application or implementation of the law in society. Data collection was conducted through interviews with informants to obtain the necessary information. Furthermore, all data obtained was analyzed qualitatively using Soerjono Soekanto’s theory of legal effectiveness, resulting in conclusions.
The research results indicate that the Bantul Regency Government has implemented the mandate of Gubernatorial Instruction Number 5 of 2024 in accordance with established provisions. However, the effectiveness of Bantul Regency Regulation Number 4 of 2019 has not been fully achieved due to several obstacles. In terms of legal substance, it does not clearly regulate the distribution of alcoholic beverages online. From the perspective of law enforcement officials, limited personnel hinder the implementation of control and supervision. Meanwhile, community indicators indicate that there are still patterns of compromising behavior regarding violations of regulations.
