"The expansion of the internet has fostered the growth of various forms of\r\ncriminal acts, leading to the exploitation of digital platforms for offenses such as\r\nthe promotion of online gambling sites. Efforts to combat these criminal acts are\r\nbroadly divided into two forms: penal and non-penal. As a penal measure,\r\nprohibitions related to gambling and related activities are stipulated in the\r\nCriminal Code (KUHP) and the Electronic Information and Transaction Law (UU\r\nITE), while the non-penal approach focuses more on preventive measures. The\r\nauthor is interested in discussing and analyzing the issue of gambling, which has\r\nbecome highly crucial in the period of 2023 to the present. This research aims to\r\ndetermine How the implementation and effectiveness of the role of Diskominfo DIY\r\n(Communication and Information Agency of the Special Region of Yogyakarta)\r\nfunction as an instrument of non-penal policy in counteracting online gambling site\r\npromotion.\r\nThis research was conducted using a descriptive-analytical methodology.\r\nThe type of research employed is juridical-empirical, utilizing primary data sources\r\nobtained directly through interviews with informants from the Communication and\r\nInformation Agency of the Special Region of Yogyakarta. Furthermore, the author\r\nused secondary data sources derived from prevailing regulations, academic books,\r\nand related journals. Data collection techniques included interviews, literature\r\nreview, and documentation to support and answer the problems raised in this study.\r\nIn this research, the author employs the principle of lex specialis and the theory of\r\ncriminal law Non-Penal policy.\r\nBased on the research findings, it can be concluded that in the effort to\r\ncombat the crime of online gambling promotion, Article 27 paragraph (2) of the\r\nUU ITE satisfies the juridical legal relevance, as its article elements provide legal\r\ncertainty while simultaneously serving as the lex specialis over the KUHP.\r\nFurthermore, the role of Diskominfo DIY as the application of non-penal policy in\r\ncounteracting the crime of online gambling promotion is highly crucial because it\r\ninvolves preventive and proactive efforts in accordance with the Kominfo\r\nInstruction No. 1 of 2023 concerning the handling of online gambling."^^ .
