N2  - The expansion of the internet has fostered the growth of various forms of
criminal acts, leading to the exploitation of digital platforms for offenses such as
the promotion of online gambling sites. Efforts to combat these criminal acts are
broadly divided into two forms: penal and non-penal. As a penal measure,
prohibitions related to gambling and related activities are stipulated in the
Criminal Code (KUHP) and the Electronic Information and Transaction Law (UU
ITE), while the non-penal approach focuses more on preventive measures. The
author is interested in discussing and analyzing the issue of gambling, which has
become highly crucial in the period of 2023 to the present. This research aims to
determine How the implementation and effectiveness of the role of Diskominfo DIY
(Communication and Information Agency of the Special Region of Yogyakarta)
function as an instrument of non-penal policy in counteracting online gambling site
promotion.
This research was conducted using a descriptive-analytical methodology.
The type of research employed is juridical-empirical, utilizing primary data sources
obtained directly through interviews with informants from the Communication and
Information Agency of the Special Region of Yogyakarta. Furthermore, the author
used secondary data sources derived from prevailing regulations, academic books,
and related journals. Data collection techniques included interviews, literature
review, and documentation to support and answer the problems raised in this study.
In this research, the author employs the principle of lex specialis and the theory of
criminal law Non-Penal policy.
Based on the research findings, it can be concluded that in the effort to
combat the crime of online gambling promotion, Article 27 paragraph (2) of the
UU ITE satisfies the juridical legal relevance, as its article elements provide legal
certainty while simultaneously serving as the lex specialis over the KUHP.
Furthermore, the role of Diskominfo DIY as the application of non-penal policy in
counteracting the crime of online gambling promotion is highly crucial because it
involves preventive and proactive efforts in accordance with the Kominfo
Instruction No. 1 of 2023 concerning the handling of online gambling.
