"The phenomenon of husbands or wives who continue to maintain their\r\nmarriages despite having spouses with mental disabilities represents a social reality\r\nthat challenges the normative construction of Islamic family law, which is generally\r\nbuilt upon assumptions of ideal and fully functional spousal relations. In this context,\r\nthis study examines three main issues: the reasons why husbands or wives remain in\r\nmarriages with partners experiencing mental disabilities; the challenges and\r\nstrengthening potentials of family resilience they encounter; and the position of the\r\nfulfillment of spouses’ rights and obligations under such conditions.\r\nThis research employs a qualitative method with a phenomenological\r\napproach and was conducted in Margasari Village, Sidareja Subdistrict, Cilacap\r\nRegency. Data were collected through in-depth interviews with married couples in\r\nwhich one spouse experiences mental disability and documentation. Data analysis was\r\ncarried out using the Family Strength Framework proposed by Nick Stinnett and John\r\nDeFrain to examine family resilience dynamics, alongside the Maqa>s}id al-Usrah\r\ntheory formulated by Jamaluddin ‘Athiyyah as a normative framework for assessing\r\nIslamic family law principles.\r\nThe findings reveal that the decision to remain in marriage is driven by moral\r\ncommitment, religious belief, and a sense of responsibility toward the family. The main\r\nchallenges faced include dual role burdens, social stigma, economic pressure,\r\nuncertainty about the future, and imbalance in the fulfillment of spouses’ rights and\r\nobligations. Nevertheless, family resilience is strengthened by several supporting\r\nfactors, including spirituality, enduring affection and commitment, adaptive capacity\r\ndeveloped through experience, and support from extended family members, local\r\ncommunities, and community leaders.\r\nFrom the perspective of maqāṣid al-usrah, the fulfillment of spouses’ rights\r\nand obligations in families with mentally disabled partners is flexible and contextual,\r\noriented toward preventing harm and realizing family welfare. This study concludes\r\nthat family resilience in such circumstances does not contradict Islamic family law\r\nprinciples, but rather reflects the application of substantive justice in line with the\r\nobjectives of Islamic law in preserving family continuity and harmony."^^ .
