The increasing phenomenon of empty boxes is a danger signal in electoral democracy, especially after the issuance of Law Number 10 of 2016, PKPU Number 13 of 2015, PKPU Number 8 of 2024 which are full of loopholes or serious problems in the design of nomination regulations This research is a normative legal study using a statute approach. This was done by examining laws and regulations, court decisions, and technical regulations governing election administration as primary legal sources. To measure the fulfillment of legal certainty in these regulations, the authors used data collection techniques based on document or literature studies, which were then processed qualitatively. The research results show that regulations issued after the Constitutional Court Decision have not fully met the elements of legal certainty, based on Gustav Radbruch's perspective. The four indicators that should have been met have not been fully implemented in the creation of legislation. The indicators of normative clarity, consistency and stability, and predictability do not reflect legal certainty, as evidenced by the numerous judicial reviews filed with the Constitutional Court, which have opened up opportunities for legal smuggling. Only the non-retroactive indicator has been met, although there has been a shift in meaning. Therefore, Law Number 10 of 2016 can be said to have not fully achieved legal certainty. Meanwhile, technical regulations, namely General Elections Commission Regulation Number 8 of 2024, have also not fully achieved legal certainty. The indicators of normative clarity and non-retroactiveness do not align with the indicators of predictability and stability.
