However, the enactment of Peraturan Pemerintah Nomor 18 Tahun 2021 brings fundamental changes to the legal position of written evidence of used customary land, especially through the provisions of Article 96 which requires conversion into a Certificate of Ownership within a period of five years. This provision raises legal issues related to the certainty and protection of land rights, especially for landowners who have not converted and its implications in resolving civil disputes in court. Therefore, this study focuses on the legal position and protection of the ownership of used customary land after the enactment of Peraturan Pemerintah Nomor 18 Tahun 2021 and the status of written evidence in civil disputes. This research is a normative legal research with a descriptive-analytical nature. The approaches used include a regulatory approach and a conceptual approach. The research data is sourced from primary, secondary, and tertiary legal materials that are analyzed qualitatively. The theoretical framework used in this study includes legal protection theory, evidentiary theory in civil cases, and land ownership rights theory, which are used as analytical knives to assess the juridical consequences of changing the status of land used by customs. The results of the study show that former customary land that has not been converted into a Certificate of Ownership after the enactment of Peraturan Pemerintah Nomor 18 Tahun 2021 still has limited legal recognition, but no longer has a position as strong evidence of ownership. Written evidence of used land belonging to customary property only serves as a guide to land registration and merely constitutes preliminary evidence, requires the support of other evidence in civil disputes.
