abstract: The appointment of Raffi Ahmad as Special Envoy to the President by President Prabowo Subianto, as stipulated in Presidential Regulation No. 137 of 2024, has sparked academic debate regarding the basis for consideration and rationality of appointing public figures to non-structural government positions. To date, legal and fiqh siyasah studies have not provided a comprehensive explanation of the rationality of appointing a Special Envoy to the President, especially when viewed from the principles of Islamic leadership and the concept of siyāsah syar‘iyyah. This condition indicates the need for academic studies that can bridge the constitutional authority of the President and normative values in Islamic political thought. The position of Special Envoy to the President is outside the conventional bureaucratic structure, but has a strategic role in assisting the President in carrying out certain tasks as required by the government.
This study is a library research with a normative juridical approach and qualitative descriptive method. Data sources include primary legal materials such as legislation, secondary legal materials in the form of scientific literature and Islamic references, and tertiary legal materials such as encyclopedias and dictionaries. The principles of Islamic leadership according to Al-Māwardī and the concept of siyāsah syar'iyyah according to Ibn Aqil are used as analytical tools in this study.
The results of the study show that the appointment of Raffi Ahmad as Special Envoy to the President is part of the President's authority in carrying out governmental functions, which is based on certain strategic considerations. Viewed from the principles of Islamic leadership according to Al-Māwardī, this appointment can be understood as an effort to place individuals who are considered to have the capacity, social influence, and communication skills to support the interests of the government. Meanwhile, based on the concept of siyāsah syar‘iyyah according to Ibn Aqil, the appointment reflects the use of the ruler's discretion oriented towards the public interest, as long as it does not conflict with the principles of sharia and the interests of the wider community.
