In the implementation of financing, the prudential principle serves as an important foundation to minimize risks and maintain the financial health of the institution. The prudential principle functions not only as a risk mitigation mechanism, but also as a form of responsibility towards the funds being managed. However, in practice, the implementation of this principle often faces challenges, particularly related to the real conditions of customers in the field that are not always aligned with data, namely non-performing financing. This research aims to examine the implementation of the prudential principle using 5C analysis in qardh contract financing at Bank Wakaf Mikro (BWM) Almuna Berkah Mandiri Krapyak Yogyakarta and to analyze the dispute resolution mechanism when problems occur in financing. This research is an empirical study conducted systematically to collect data in the field. The research approach used is a juridical-empirical approach using applicable laws and regulations, and empirically carried out through observations and interviews at Bank Wakaf Mikro (BWM) Almuna Berkah Mandiri Krapyak Yogyakarta. The research findings indicate that the implementation of the prudential principle in financing at BWM Almuna Berkah Mandiri Krapyak Yogyakarta is in accordance with the mandate of Law Number 1 of 2013 concerning Microfinance Institutions and Financial Services Authority Regulation (POJK) Number 41 of 2024 concerning Microfinance Institutions. The application of the prudential principle is implemented from the beginning of the financing application process, feasibility analysis based on the 5C principle comprehensively in financing provision, where the aspects of character and capacity become priority aspects of financing distribution and financing risk control, as well as collateral which is replaced with "social collateral". However, the reality in the field shows that the implementation of the prudential principle is still lacking because there are still customers who experience problems in the financing process. Several contributing factors include unstable business conditions that cause unstable customer economies, changes in customer character which become reasons for inability to pay installments, and customers who do not have good faith to return the financing as agreed.
