The issue of interfaith marriage in Indonesia has long been debated due to different interpretations of Law Number 1 of 1974 on Marriage and judicial practices that previously allowed the registration of interfaith marriages through court determinations. The issuance of SEMA Number 2 of 2023 provides guidance for judges to reject applications for the registration of marriages between individuals of different religions. This research is a normative legal study employing a statutory approach and a conceptual approach. The legal materials consist of primary legal materials such as legislation and court decisions, secondary legal materials including books and academic journals, and tertiary legal materials as supporting references. The data were collected through library research and analyzed qualitatively using a descriptive-analytical method. The results show that SEMA Number 2 of 2023 strengthens the Supreme Court’s stance in limiting the authority of courts to grant applications for the registration of interfaith marriages. This policy significantly affects judicial practice by closing the legal avenue previously used by interfaith couples through court determinations.
