Mining management authority is divided between the central and regional governments, but this division is not always applied uniformly, especially for regions with special autonomy status such as Papua. Differences in regulations between Law Number 2 of 2021 concerning the Second Amendment to Law Number 21 of 2001 concerning Special Autonomy for Papua and Law Number 3 of 2020 concerning Amendments to Law Number 4 of 2009 concerning Mineral and Coal Mining give rise to the potential for recentralization of authority and disharmony of norms in mining management practices in Papua. This research is a normative legal research with a statutory, conceptual, and historical approach. This study aims to explain the problems of centralization of central authority in mining management in Papua reviewed from the Papua Special Autonomy Regulation and Mineral and Coal Mining in Indonesia and the formulation of ideal legal harmonization to align mining management authority in Papua. The main data sources used are the 1945 Constitution of the Republic of Indonesia, relevant laws and regulations, and related Constitutional Court decisions. The theoretical framework used includes the theory of authority, asymmetric decentralization, and maslahah mursalah as the basis for analysis in assessing the relationship between central and regional authority. The results indicate that the centralization of mining management authority in Papua is due to a disharmony of norms between the Papuan Special Autonomy Regulation and the Mineral and Coal Mining Law.
