%A NIM.: 22103070084 Febrian Gayuh Abdul Jabbar %O Dr. Ocktoberrinsyah, M.Ag. %T ANALISIS HUKUM DALAM PENERAPAN KODE ETIK OLEH ANGGOTA POLISI PADA PERATURAN KEPOLISIAN NO. 7 TAHUN 2022 (STUDI KASUS PEMERASAN WARGA NEGARA MALAYSIA OLEH OKNUM POLISI NARKOBA) %X The role of the Indonesian National Police (Polri) as a state law enforcement agency tasked with providing services, protection, and security to the public, however, in practice, violations of the Police Professional Code of Ethics (KEEP) frequently occur. One such case is the extortion of 45 Malaysian citizens by drug police officers at the Djakarta Warehouse Project (DWP) event in Jakarta in December 2024. This study aims to answer how the Code of Ethics sanctions are applied to the behavior of police officers who violate the case of extortion of Malaysian citizens by drug police officers, and how the Fiqh Siyasah review according to Imam al-Mawardi in his book Al-Ahkam As-Sulthaniyyah regarding the view of violations of the Code of Ethics of the Indonesian National Police. This research is a library research. Primary data sources in this study include Police Regulation No. 7 of 2022 concerning the Code of Ethics and the Indonesian National Police Code of Ethics Commission, and Law No. 2 of 2002 concerning the Indonesian National Police. Secondary data sources included all publications on law, the Quran, and books or journals. The data analysis technique used was Juridical-Normative analysis. The results of this study indicate that the imposition of sanctions against 20 police officers in the extortion case of Malaysian citizens at the DWP in 2024 was carried out through an ethics trial based on Police Regulation No. 10/2024. Although it has fulfilled the criminal elements according to Article 369 of the Criminal Code and the Corruption Law, the legal process did not proceed to the criminal realm due to the minimal participation of victims who were reluctant to continue due to concerns about compensation, thus hindering the upholding of the principle of equality before the law. In Fiqh Siyasah, this act of extortion is a betrayal of the leadership mandate that invalidates the "fair" nature for officials as leaders and lower-ranking members as technical implementers, because obedience to superior orders does not apply if it fulfills the elements of injustice.
