Although this digital platform offers convenience, it also brings various legal challenges, one of which is the practice of fake orders, which often causes losses for drivers. This issue is essential to examine, especially in the context of legal protection for Gojek drivers in Bantul Regency, who frequently become victims of such harmful practices. This research aims to analyze the form of legal protection for Gojek drivers against fake orders and to identify the obstacles and factors that influence the effectiveness of such protection. The study applies an empirical juridical method with statutory, conceptual, and case approaches. Data were collected through interviews with Gojek drivers in Bantul Regency and a literature review of Law Number 20 of 2008 concerning Micro, Small, and Medium Enterprises (MSMEs). The data were analyzed qualitatively using the theory of legal protection (Philipus M. Hadjon) and the theory of partnership as analytical frameworks. The findings reveal that legal protection for Gojek drivers who experience fake orders has not been effectively implemented. Although, in principle, drivers are classified as micro-entrepreneurs entitled to protection and empowerment, the company’s protection mechanisms remain administrative, provided through features such as Lapor Ofik and GoShield. These mechanisms do not yet ensure adequate legal certainty or compensation for the drivers’ actual losses. The main obstacles include the imbalance of partnership relations, weak consumer verification systems, low legal awareness among drivers, and the absence of specific regulations addressing the protection of digital-based micro-entrepreneurs such as online drivers. In conclusion, legal protection for Gojek drivers in cases of fake orders remains normative rather than substantive. Active government involvement is required to establish specific regulations that protect digital micro-entrepreneurs. Additionally, the company must enhance transparency and accountability in handling fake order cases.
