convenience and unique appeal to consumers, primarily due to the more
affordable prices compared to brand-new shoes. However, this online trading
practice often lacks sufficient detailed information about the condition of the
products and limits the buyer's opportunity to verify the quality directly, leading
to a potential mismatch between consumer expectations and the received goods.
Based on this condition, this study raises the issue of the application of the khiyār
principle in online thrifting shoe transactions in Yogyakarta, as well as how this
principle is viewed from the perspective of Islamic law and Indonesian positive
law.
This research employs a mixed-method approach, combining field studies
and literature review, with a descriptive-analytical methodology. Data were
collected through interviews with online thrift shoe sellers and consumers, and
analyzed using online trading theory, khiyār theory, and consumer protection
theory.
Based on the analysis, it can be concluded that the application of the
khiyār principle, particularly khiyār 'aib, has been substantively implemented in
online thrifting shoe transactions in Yogyakarta. Sellers generally grant
consumers the right to return the product if hidden defects are found, provided
that the return is supported by valid evidence in the form of a complete unboxing
video. The implementation of this right also reflects consumer protection as
regulated in Article 7 points (b) and (g) of Law Number 8 of 1999 concerning
Consumer Protection, which requires business actors to provide honest and
accurate information and to compensate for any goods received that are not in
accordance with the agreement.</mods:abstract><mods:classification authority="lcc">Jual Beli dalam Islam</mods:classification><mods:originInfo><mods:dateIssued encoding="iso8061">2025-07-16</mods:dateIssued></mods:originInfo><mods:originInfo><mods:publisher>UIN SUNAN KALIJAGA YOGYAKARTA;FAKULTAS ILMU TARBIYAH DAN KEGURUAN</mods:publisher></mods:originInfo><mods:genre>Thesis</mods:genre></mods:mods>
