However, the provisions in the Criminal Law Adjustment Act, namely Article (1), which removes the specific minimum criminal penalty, has the potential to cause ambiguity in norms and regulatory conflicts. This situation raises questions about the direction of criminal law policy in terms of depenalization and its implications for legal certainty and efforts to protect society.&#13;
The method used is juridical-normative, supported by field data as evidence and literature studies to strengthen the normative analysis. Three theoretical frameworks are used in this study, namely the concept of criminal law politics, the theory of punishment, and the theory of legal certainty as the basis for assessing the consistency of regulations and their implications for the criminal justice system.&#13;
The results of the study show that the decriminalization policy in the National Criminal Code and the Criminal Adjustment Law is considered relevant if it is applied only to drug abusers, not to all perpetrators of drug crimes. In addition, the elimination of specific minimum penalties has the potential to increase disparities in sentencing and give rise to normative conflicts between the National Criminal Code, the Criminal Adjustment Law, and the Narcotics Law as special criminal laws.
