One of the points of contention is the ruling on menstruating women entering mosques. The differing opinions among scholars reflect the diversity of interpretations of Islamic legal texts, such as the differences between the fatwa institutions Dar Al-Ifta’ Al-Misri and Da’irah Al-Ifta’ Al-’Amm Al-Urduni. In this study, the fatwas from both institutions are important to examine, as both institutions are from countries with the largest Muslim populations in the world, and both institutions serve as a reference point for fatwas for other Islamic countries.&#13;
This study uses legal hermeneutics theory to analyze the differences in fatwas from Dar Al-Ifta’ Al-Misri and Da’irah Al-Ifta’ Al-’Amm Al-Urduni regarding the law on menstruating women entering mosques. This is a qualitative study with a descriptive-analytical-comparative nature. Data collection techniques were conducted through library research. The data for this study were obtained from the fatwas of Dar Al-Ifta’ Al-Misri and Da’irah Al-Ifta’ Al-’Amm Al-Urduni as primary data and supporting data from various relevant literature on this topic.&#13;
The results of the study indicate that Dar Al-Ifta’ Al-Misri permits menstruating women to enter mosques, based on the absence of explicit textual evidence prohibiting their presence in mosques. Its fatwa is inclusive, taking into account the needs of modern society and prioritizing the greater good. Meanwhile, the Jordanian General Fatwa Council prohibits menstruating women from entering mosques based on the principle of maintaining the sanctity of mosques, being more cautious in preserving the sanctity of mosques, and adopting a more conservative approach in interpreting textual evidence. This difference highlights the role of social context, methodological approaches, and the academic characteristics of each fatwa institution in establishing legal rulings.
