In industrial relations, the balance between employers and workers is the key to achieving justice, expediency, and legal certainty. However, in practice, unilateral policies by employers still frequently occur and have the potential to disadvantage workers, particularly regarding changes in retirement age. This issue is reflected in the policy of the Board of Directors Decree of PT. Taru Martani which lowered the retirement age, thereby causing industrial relations disputes and resulting in Decision Number 44/Pdt.Sus-PHI/2025/PN Yyk. This study employs an empirical legal method with a statutory approach and a case approach. The legal materials used include primary and secondary legal sources, which are analyzed qualitatively. This approach aims to examine the conformity of company policies with applicable labor law provisions and to assess the judges’ considerations in the decision. The results of the study indicate that the judges’ considerations in the decision have emphasized the principle of legal protection for workers. However, the policy of changing the retirement age through a Board of Directors Decree does not fully meet the principle of legal certainty, as it was implemented without mutual agreement with the workers.
