A lack of understanding of religious values, along with easy access to information in the digital age, exacerbates this situation. Promiscuity contributes to an increase in cases of sexually transmitted infections (STIs), teenage pregnancies, and deaths due to HIV/AIDS. The government has issued policies such as Law No. 16 of 2019, which amends Law No. 1 of 1974 on Marriage, and Government Regulation No. 28 of 2024, which regulates the implementation of Law No. 17 of 2023 on Health, in an effort to address these problems, including the provision of contraceptives for adolescents. However, the provision regarding contraceptives has sparked controversy due to the lack of clarity concerning the target users. Therefore, this study aims to examine the provision of contraceptives from the perspective of the welfare of adolescent reproductive health. This research is a qualitative study with an usul fiqh approach, focusing on the controversy surrounding the provision of contraceptives for adolescents, by referring to the views of scholars and academics. Interviews were used as the data collection technique, while the analysis is based on the theory of maslahah to examine the arguments, underlying reasoning, and the factors that contribute to the differences of opinion among religious figures and intellectuals. Based on the analysis of scholars' and academics' perspectives through the lens of ma?la?ah theory, it can be concluded that the policy of providing contraceptives to adolescents falls within a domain of ijtih?d that requires caution, balance, and contextual consideration. The principle of ma?la?ah demands that any policy be directed toward the protection of the five essential objectives of Islamic law (maq??id al-shar??ah), particularly the preservation of life and lineage. This approach calls for policies that are not generalized but instead take into account the social environment, religious values, and potential harm. In certain cases, the provision of contraceptives may be seen as an exception (istithn??) permitted to prevent greater harm, as long as it does not explicitly contradict the core principles of the Sharia.
