The issue becomes more complex when the perpetrator is an elderly person, who normatively is also categorized as avulnerable group entitled to legal protection. This study aims to analyze the legal protection afforded to children as victims and elderly individuals as perpetrators of rape crimes based on principle of ex aequo et bono within the Indonesian criminal justice system, by examining the Decision of the Banyumas District Court Number 98/Pid.Sus/2022/PN Bms. This research employs a normative juridical approach with a descriptive-analitycal method, relying on literature review of laws, legal doctrines, and secondary data. Legal materials consist of primary, secondary, and tertiary legal sources. The data analysis technique used is qualitative analysis, emphasizing legal norm interpretation and ethical-humanitarian considerations. The finding indicate that legal protection for child victims is comprehensively regulated through various statutory provisions. However, legal treatment for elderly perpetrators remains limited, even though the Constitution guarantees special protection for the elderly. The application of the ex aequo et bono principle allows for substantive justice that makes into account the objective condition of elderly offenders without neglecting the rights of child victims. Thus, a balance can be achieved between protecting children and ensuring humane treatment of the elderly in criminal proceeding. %Z Dr. Ahmad Bahiej, S.H., M.Hum.
