The obligation to conduct drug assessments is stipulated in the Joint Regulation of 7 Ministries/Institutions concerning the Handling of Drug Addicts and Victims of Drug Abuse within Rehabilitation Institutions, which establishes an Integrated Assessment Team (TAT) as a mandatory instrument before determining a suspect's legal status. However, 2025 data shows that of the 54 suspects who underwent assessments, only 9 were sentenced to rehabilitation, and 44 were sentenced to prison. This situation indicates a tendency toward criminalization rather than rehabilitation.&#13;
This study focuses on analyzing the factors causing the suboptimal implementation of integrated assessments and their compliance with the Joint Regulation of 7 Ministries/Institutions and Law Number 35 of 2009 concerning Narcotics. This study uses Tony F. Marshall's Restorative Justice Theory and Soerjono Soekanto's Legal Effectiveness Theory as the analytical foundation to address this problem. The method employed is empirical juridical with a descriptive analytical approach, collecting primary data through interviews and secondary data through literature review of laws and regulations. The research was conducted at the National Narcotics Agency of the Special Region of Yogyakarta Province (BNNP DIY) and the Nawacita Community-Based Addiction Recovery Center (PABM) in Yogyakarta.&#13;
The results indicate that the implementation of the assessment in Yogyakarta is not yet optimal in practice. The TAT recommendations are not binding and are often ignored by judges in their decision-making. Furthermore, most TAT recommendations state that "the legal process will continue with rehabilitation," meaning that rehabilitation continues concurrently with sentencing. The implementation of the assessment in Yogyakarta is also not fully compliant with the Joint Regulation of 7 Ministries/Institutions and Law Number 35 of 2009 concerning Narcotics. Although the TAT has been implemented institutionally, the assessment's function as a tool for determining the direction of rehabilitation is not yet effective. This is influenced by factors such as law enforcement still focusing on punishment, cultural factors that have not yet shifted to a rehabilitative paradigm, and the lack of facilities, such as rehabilitation costs not being fully covered by the state.
