This study is motivated by differences in the regulation of polygamy, where state law still allows limited polygamy under certain conditions, while the Sunda Wiwitan community absolutely prohibits it based on customary values and beliefs. This research is field research using a descriptive-analytical-comparative approach. Primary data were obtained through interviews with customary leaders and members of the Sunda Wiwitan community in Cigugur, while secondary data were collected through literature studies, including legislation, books, journals, and other relevant legal sources. The data were analyzed qualitatively by comparing customary marriage law with national marriage law and examining them through Roscoe Pound’s Social Engineering Theory and Jasser Auda’s Maqāṣid al-Sharī‘ah Theory. The results indicate that Sunda Wiwitan customary marriage law absolutely prohibits polygamy, whereas Law Number 1 of 1974 concerning Marriage regulates and permits polygamy under limited conditions.
