This regulation empowers Prosecutors, acting as Dominus Litis, to terminate prosecutions and divert narcotics abusers into rehabilitation programs. However, the implementation of this policy faces new procedural challenges following Undang-Undang Nomor 20 Tahun 2025 (KUHAP), which demands further institutional adaptation. This research aims to analyze the implementation of PJA 18/2021 at Kejaksaan Tinggi Daerah Istimewa Yogyakarta (Kejati DIY) and evaluate these practices through the perspective of Maqāṣid Asy-Syarī‘ah. This research is an empirical juridical research using a sociological approach. Primary data were obtained through interviews with key informants at Kejati DIY, while secondary data encompass PJA 18/2021, Surat Edaran Jaksa Agung (SEJA 1/2025) and other relevant regulations. The data analysis was conducted using Soerjono Soekanto's Legal Effectiveness Theory to assess implementation barriers and John Rawls' Theory of Justice to examine fairness. Furthermore, Jasser Auda's Maqāṣid Shari’ah systems approach was applied to understand the holistic objectives and societal benefits of the rehabilitation policy within a contemporary Islamic legal framework. Implementing PJA 18/2021 at Kejati DIY achieved targeted restorative justice through autonomous delegation, TAT synergy and intelligence profiling. However, the new KUHAP requires immediate internal guideline adjustments to prevent normative disharmony regarding bureaucracy, recidivism limits and terminology. Operationally, missing parameters cause decision disparities, while mandatory inpatient care risks overcapacity. Achieving substantive justice demands regulatory harmonization, paradigm alignment and infrastructural reinforcement. From Jasser Auda's Maqāṣid Asy-Syarī‘ah perspective, the policy actualizes ḥifẓ al-nafs and ḥifẓ al-‘aql. Through its “cognitive nature” and “multidimensional feature”, the al-ʾIṣlāḥ principle is applied via mandatory inpatient care.
