The 2021 internal conflic in the Democratic Party, involving the Agus Harimurti Yudhoyono and Moeldoko camps, resulted in dualism in party leadership, which led to the resolution of disputes through litigation at the PTUN. The research questions are as follows: 1. How is the internal conflict within the Democratic Party resolved through the PTUN from the perspective of Law Number 2 of 2011 concerning political parties? 2. How is the internal conflict within the Democratic Party resolved from the perspective of Islamic jurisprudence (fiqh siyasah)? This study aims to analyze the mechanism for resolving internal political party conflicts based on positive law and to review its compliance with the principles of Islamic jurisprudence (fiqh siyasah). This research is normative legal. It is descriptive and analytical in nature, and uses a juris-normative approach. Data collection techniques include library research. This involves collecting, inventorying, and analyzing data obtained from primary and secondary legal materials, as well as a case study approach. Qualitative data analysis was conducted after obtaining legal materials through the literature review. The results indicate that resolving the Democratic Party's internal conflict through the State Administrative Court (PTUN) is a legally valid step to obtain legal certainty regarding the legitimacy of party leadership. However, the resolution mechanism through the Party Court, as stipulated in the Political Party Law, has not been optimal. From a fiqh siyasah perspective, resolving internal party conflicts should prioritize the principles of syura (law), justice, trustworthiness, and public welfare through internal party deliberation.
