"Halal certification is mandatory to ensure that products circulating in the\r\nmarket comply with the Halal Product Assurance System (Sistem Jaminan Produk\r\nHalal/SJPH). The issuance of Government Regulation Number 42 of 2024 alters\r\nthe validity period of halal certificates from a fixed four-year term to a regime in\r\nwhich certificates remain valid as long as there is no change in the composition of\r\ningredients and/or Halal Product Process (Proses Produk Halal/PPH). This policy\r\nshift raises issues of legal certainty because it transfers self-monitoring\r\nresponsibilities to Micro and Small Enterprises (Usaha Mikro dan Kecil/UMK),\r\nwhich generally face limited administrative capacity. In practice, this condition\r\nmay generate divergent interpretations regarding the obligation to report changes\r\nand to renew halal certificates, and may ultimately affect the reliability of halal\r\nassurance. Against this background, this study aims to analyze the legal certainty\r\nof the validity period of halal certificates in relation to halal product assurance\r\nafter the enactment of Government Regulation Number 42 of 2024, focusing on\r\nMicro and Small Enterprises (UMK) in Sleman Regency.\r\nThis research employs an empirical juridical method with a descriptiveanalytical\r\ncharacter, using a socio-legal and Islamic legal studies approach. The\r\ndata are drawn from primary legal materials in the form of relevant regulations and\r\nfrom field data obtained through observation, documentation, and in-depth\r\ninterviews with UMK actors, and are then analyzed qualitatively. The analytical\r\nframework is built upon the Theory of Legal Certainty and al-Syathibi’s Theory of\r\nMaslahah.\r\nThe findings indicate that, from the perspective of the Theory of Legal\r\nCertainty, Government Regulation Number 42 of 2024 normatively provides clearer\r\nrules by shifting the validity of halal certificates from a periodic renewal system to\r\ncontinuous validity based on the substantive condition of the product. Empirically,\r\nhowever, legal certainty has not been fully realized due to the absence of clear\r\noperational technical guidelines, which creates ambiguity and differing\r\nunderstandings among UMK actors regarding post-certification reporting\r\nobligations. From the perspective of al-Syathibi’s Theory of Maslahah, the policy\r\nin principle fulfils aspects of daruriyah maslahah, particularly the protection of\r\nreligion (hifz al-din), life (hifz al-nafs), and property (hifz al-mal). Nevertheless, the\r\nexpected maslahah has not been optimally achieved because supervision remains\r\nweak and business actors’ understanding of the applicable provisions is still limited."^^ .
