bibo:abstract "This study examines the granting of Special Mining Business Licenses (IUPK) to the religious organizations Nahdlatul Ulama and Muhammadiyah under Government Regulation No. 25 of 2024 from the perspectives of legal politics and the maqasid al-sharia. This study is motivated by the emergence of controversy regarding the prioritization of mining business permit areas for religious organizations, which is deemed to have the potential to create conflicts of interest, weaken the independence of religious institutions, and cause social and ecological impacts due to mining activities. This study aims to determine the legal-political direction of this policy and to analyze its alignment with the principles of maqasid syariah.\r\nThe research design employed is normative legal research using legislative, conceptual, and historical approaches. Data sources were obtained through a literature review of primary, secondary, and tertiary legal materials, analyzed using a qualitative descriptive method. This study employs legal policy theory and the maqasid syariah, particularly focusing on the aspects of hifdz ad-din, hifdz al-‘aql, hifdz an-nafs, hifdz an-nasl, hifdz al-mal, and hifdz al-bi’ah.\r\nThe research findings indicate that the policy of granting IUPKs to religious organizations reflects a legal policy that tends to be conservative and centralistic, as it is influenced by the political interests of those in power rather than the public interest. From the perspective of maqasid syariah, the involvement of religious organizations in the mining sector has the potential to undermine the independence of da’wah, weaken moral objectivity, create economic dependency, and threaten public safety and environmental sustainability. Through the concept of hifdz al-bi’ah, Ali Yafie emphasizes that environmental conservation is an integral part of the objectives of Islamic law; therefore, religious organizations should continue to serve as moral forces and social regulators rather than becoming directly involved in the extractive industry, which has the potential to cause greater harm than benefit."^^xsd:string;
