bibo:abstract "The fatwas of the Indonesian Ulema Council (MUI), as products of Islamic\r\nlaw, play a significant role in the Indonesian national legal system, especially given\r\nthe country's Muslim-majority population. However, MUI fatwas in the political\r\nand state administration sectors during the reform era have shown disharmony with\r\nexisting legal regulations. The fundamental difference lies in the underlying\r\nconsiderations; legal regulations are based on academic drafts with juridical,\r\nsociological, and philosophical impact analyses, while MUI fatwas are formulated\r\nbased on comprehensive studies of fuqaha̅\r\n’ and scholars without a standardized\r\nformat. This disharmony is evident in fatwas related to gender reassignment and the\r\nuse of voting rights in general elections, which often overlook the state's obligation\r\nto protect citizens' rights.\r\nThis research employs a deconstruction approach to the impact analysis\r\ndesign of MUI fatwas, utilizing the theoretical frameworks of Taqni̅n al-Aḥka̅ m Ibn\r\nal-Muqaffa’, Critical Legal Studies, and Regulatory Impact Analysis. The research\r\ntype is normative legal research with a descriptive-analytical nature. The\r\napproaches used include statutory, conceptual, and case approaches. Data sources\r\ncomprise primary, secondary, and tertiary legal materials, collected through\r\ndocument studies and analyzed descriptively-qualitatively.\r\nThe research findings indicate that the ratio legis of MUI fatwas in politics\r\nand state administration from 1998-2024, viewed through the lens of Taqni̅n al-\r\nAḥka̅ m Ibn al-Muqaffa’, reveals diverse patterns of emergence and objectives, yet\r\noften lacks comprehensive integration with the national legal system. The\r\nmechanism of fatwa formation, analyzed using Regulatory Impact Analysis and\r\nCritical Legal Studies, highlights the need for reformulation to achieve harmony.\r\nTherefore, a reformulation of the impact analysis design for MUI fatwas is\r\nproposed, involving the revitalization of the Ma’a̅\r\nla̅\r\nt al-Af ’a̅\r\nl framework and the\r\nmodernization of its convergence with Regulatory Impact Analysis, alongside the\r\npractical reformulation of comprehensive MUI fatwa studies."^^xsd:string;
