      "abstract": "The 523-day vacancy of the Regional Secretary (Sekda) of Sidoarjo\r\nRegency, from March 2022 to March 2024, confirms the degradation of\r\nlegal compliance and the systemic disregard for bureaucratic stability,\r\nwhich has undermined the dignity of regional government. This strategic\r\nposition has been left without a permanent official for an unreasonable\r\nperiod of time, raising questions about the effectiveness of administrative\r\ncoordination and public services in Sidoarjo Regency. The research\r\nproblem focuses on evaluating the legal legitimacy of this vacancy in light\r\nof Presidential Regulation Number 3 of 2018 and the perspective of Islamic\r\njurisprudence (Fiqh siyasah).\r\nThis research employs an empirical juridical research method with\r\na juridical-sociological approach. The analytical tools employed in this\r\nstudy are Indonesian positive law, specifically regulations concerning\r\nstructural positions in regional governments, and the theoretical framework\r\nof Siyasah Dusturiyyah or Islamic jurisprudence (Fiqh siyasah). Data were\r\ncollected through a review of statutory documents and in-depth interviews\r\nwith relevant parties to examine the facts on the ground and the\r\nadministrative implications that emerged during the transition period.\r\nThe research results show a clear normative discrepancy between\r\nLaw No. 23 of 2014, Presidential Regulation No. 3 of 2018, and Minister of\r\nHome Affairs Regulation No. 91 of 2019, which restrict the term of office of\r\nActing Officials to a maximum of three months. The accumulated vacancy of\r\n523 days severely undermines the principles of legal certainty and\r\nbureaucratic effectiveness. From the perspective of Islamic jurisprudence\r\n(Fiqh siyasah), this delay is categorized as an administrative offense and a\r\nbetrayal of the leadership mandate because it hinders the function of the\r\nWizarah al-Tanfidz (Regional Implementation Supervision) in constructing\r\npublic welfare. The author concludes that this phenomenon constitutes a\r\nbureaucratic anomaly that undermines the national legal order and the\r\nprinciples of Islamic state administration. Therefore, this practice should\r\nnot be used as a precedent in the future.",
