This strategic position has been left without a permanent official for an unreasonable period of time, raising questions about the effectiveness of administrative coordination and public services in Sidoarjo Regency. The research problem focuses on evaluating the legal legitimacy of this vacancy in light of Presidential Regulation Number 3 of 2018 and the perspective of Islamic jurisprudence (Fiqh siyasah). This research employs an empirical juridical research method with a juridical-sociological approach. The analytical tools employed in this study are Indonesian positive law, specifically regulations concerning structural positions in regional governments, and the theoretical framework of Siyasah Dusturiyyah or Islamic jurisprudence (Fiqh siyasah). Data were collected through a review of statutory documents and in-depth interviews with relevant parties to examine the facts on the ground and the administrative implications that emerged during the transition period. The research results show a clear normative discrepancy between Law No. 23 of 2014, Presidential Regulation No. 3 of 2018, and Minister of Home Affairs Regulation No. 91 of 2019, which restrict the term of office of Acting Officials to a maximum of three months. The accumulated vacancy of 523 days severely undermines the principles of legal certainty and bureaucratic effectiveness. From the perspective of Islamic jurisprudence (Fiqh siyasah), this delay is categorized as an administrative offense and a betrayal of the leadership mandate because it hinders the function of the Wizarah al-Tanfidz (Regional Implementation Supervision) in constructing public welfare. The author concludes that this phenomenon constitutes a bureaucratic anomaly that undermines the national legal order and the principles of Islamic state administration.
