Regency, from March 2022 to March 2024, confirms the degradation of&#13;
legal compliance and the systemic disregard for bureaucratic stability,&#13;
which has undermined the dignity of regional government. This strategic&#13;
position has been left without a permanent official for an unreasonable&#13;
period of time, raising questions about the effectiveness of administrative&#13;
coordination and public services in Sidoarjo Regency. The research&#13;
problem focuses on evaluating the legal legitimacy of this vacancy in light&#13;
of Presidential Regulation Number 3 of 2018 and the perspective of Islamic&#13;
jurisprudence (Fiqh siyasah).&#13;
This research employs an empirical juridical research method with&#13;
a juridical-sociological approach. The analytical tools employed in this&#13;
study are Indonesian positive law, specifically regulations concerning&#13;
structural positions in regional governments, and the theoretical framework&#13;
of Siyasah Dusturiyyah or Islamic jurisprudence (Fiqh siyasah). Data were&#13;
collected through a review of statutory documents and in-depth interviews&#13;
with relevant parties to examine the facts on the ground and the&#13;
administrative implications that emerged during the transition period.&#13;
The research results show a clear normative discrepancy between&#13;
Law No. 23 of 2014, Presidential Regulation No. 3 of 2018, and Minister of&#13;
Home Affairs Regulation No. 91 of 2019, which restrict the term of office of&#13;
Acting Officials to a maximum of three months. The accumulated vacancy of&#13;
523 days severely undermines the principles of legal certainty and&#13;
bureaucratic effectiveness. From the perspective of Islamic jurisprudence&#13;
(Fiqh siyasah), this delay is categorized as an administrative offense and a&#13;
betrayal of the leadership mandate because it hinders the function of the&#13;
Wizarah al-Tanfidz (Regional Implementation Supervision) in constructing&#13;
public welfare. The author concludes that this phenomenon constitutes a&#13;
bureaucratic anomaly that undermines the national legal order and the&#13;
principles of Islamic state administration. Therefore, this practice should&#13;
