In Indonesia, the legal framework governing OGBV is primarily regulated under Law Number 12 of 2022 on Sexual Violence Crimes (the TPKS Law) and Law Number 1 of 2024 on Electronic Information and Transactions (the ITE Law). However, the coexistence of these two statutes has created normative legal disharmony, resulting in potential legal uncertainty and reducing the effectiveness of victim protection. This study aims to analyze the forms of disharmony between the TPKS Law and the ITE Law in addressing OGBV and to formulate an ideal model of legal harmonization. This research employs a normative legal research method using statutory, conceptual, and case approaches. The analysis is conducted on primary, secondary, and tertiary legal materials through a qualitative method. The study applies the concept of legal harmonization to examine the normative relationship between the TPKS Law and the ITE Law, the theory of legal protection to assess the fulfillment of victims' rights, and maqāṣid al-sharī‘ah as the philosophical foundation for developing a legal system oriented toward public welfare (maṣlaḥah), justice, and the protection of human dignity. The findings indicate that the disharmony between the TPKS Law and the ITE Law arises from differences in regulatory paradigms, ambiguity in the application of the principle of lex specialis derogat legi generali, and overlapping legal classifications of OGBV-related acts, resulting in legal uncertainty and inadequate victim protection. The resolution is pursued through substantive harmonization by affirming the TPKS Law as a special regulation for addressing OGBV characterized as sexual violence, harmonizing the application of the ITE Law, and integrating victim protection and recovery into law enforcement guidelines.
