retailers, which has generated both pros and cons, particularly regarding the&#13;
effectiveness of competition law, the dynamics of modern retail, and omnichannel&#13;
integration policies, which are no longer viewed simply as business innovations.&#13;
This study aims to analyze the potential market access barriers for traditional&#13;
businesses in modern retail from the perspective of Law No. 5 of 1999 and the&#13;
Maqāṣid al-Sharī'ah.&#13;
This research is qualitative, employing a descriptive-analytical empirical&#13;
juridical approach and a sociological approach. Data collection methods included&#13;
interviews, observations of the features and services of modern retail applications&#13;
in Indonesia, and documentation. Data analysis employed qualitative content&#13;
analysis techniques.&#13;
The results indicate that retail market share is above the dominant position&#13;
threshold as defined by Article 25 paragraph 2 of Law No. 5 of 1999. This situation&#13;
indicates the potential for abuse of a dominant position, reinforcing structural&#13;
barriers in the form of disparities in capital, economies of scale, and technological&#13;
mastery, significantly limiting market access for traditional businesses. According&#13;
to the Maqāṣid al-Sharī'ah perspective Ibn Ashur, omnichannel integration&#13;
concentrated on dominant players creates collective harm due to the creation of&#13;
injustice and market distortion, even though the potential for partnerships still&#13;
exists. This study concludes the need for stricter enforcement of competition law&#13;
and the formulation of policies that focus on regulation, digital capacity, and the&#13;
optimization of strategic partnerships to ensure the sustainability of traditional&#13;
