However, in practice, Muslim couriers often deliver non-halal food, raising contemporary fiqh issues regarding the permissibility of the wages they earn. In Islamic teachings, the concept of halal and haram extends beyond the substance of goods to include the manner of earning income and involvement in prohibited activities, as reflected in the prohibition against cooperating in sin. To assess this issue, scholars refer to the concepts of ijārah (lease of services) and ujrah (wages). Differences of opinion arise among classical scholars: Imam an-Nawawi considers such work impermissible due to its association with unlawful matters, whereas Imam al- Kasani allows it on the grounds that delivery itself is not a direct act of sin. This study aims to examine the legality of such wages and to analyze the legal reasoning of both scholars through a comparative approach. This research is a library-based study employing a descriptive-analytical method with a normative approach. Primary data are drawn from Raudhat al- Ṭālibīn by Imam an-Nawawi and Badā’i‘al-Ṣanā’i‘ by Imam al-Kasani, supported by secondary sources such as books, journals, and other scholarly works. Data are collected through documentation and analyzed through stages of data reduction, data presentation, and conclusion drawing. This approach is used to explore Islamic legal norms concerning the permissibility of wages earned by Muslim workers delivering non-halal food. The findings indicate that, according to Imam an-Nawawi, based on the theory of ijarah, delivering non-halal food does not constitute a lawful benefit, rendering the contract invalid and the wages impermissible. In contrast, Imam al- Kasani argues that delivery services are not inherently sinful acts, thus the benefit remains valid, the ijārah contract is lawful, and the wages are permissible. Both scholars agree on the centrality of ijārah and the role of benefit (manfa‘ah) in determining wage legality.
