Zumar Aminuddin, NIM.: 20300011020 297.273 Ekonomi Islam / Fiqih Muamalah The BMT in the former Surakarta residency, which serves as the nazhir for cash waqf, failed to comply with the statutory provisions regarding certification and insurance of cash waqf. Both are forms of legal protection for cash waqf. This study answers three research questions. First, why are cash waqf certification and insurance regulations not implemented in BMTs in the former Surakarta Residency, which serve as nazhir for cash waqf? Second, how do BMTs accept the idea of cash waqf? Third, how is the construction and reconstruction of cash waqf protection in BMTs? This research is a field study with a sociological approach. The BMT served as the research site. Data were obtained through interviews, documentation, and observation. Data sources included BMT administrators and BMT managers, the Head of PBMTI (Indonesian Islamic Waqf Association) for the 2010-2020 period, and Waqf Organizers from the Ministry of Religious Affairs and the Indonesian Muslim Association (BWI). Data were analyzed using interactive techniques including data reduction, data presentation, and conclusion drawing. Solo Raya was chosen because this region has a significant number of national BMT figures, and a significant number of BMTs serving as cash waqf administrators, compared to the national average. This research shows that the ineffectiveness of cash waqf certification and insurance regulations is due to several factors, namely a lack of guidance and supervision, problems with legal certainty and Islamic jurisprudence, practical habits, and the absence of social pressure. However, despite their formal non-compliance, BMTs are functionally compliant by performing protection functions through administrative instruments and risk mitigation. Existing protections need to be reconstructed so that BMT compliance is not only functional but also formal.
