"The BMT in the former Surakarta residency, which serves as the\r\nnazhir for cash waqf, failed to comply with the statutory provisions\r\nregarding certification and insurance of cash waqf. Both are forms of\r\nlegal protection for cash waqf.\r\nThis study answers three research questions. First, why are cash\r\nwaqf certification and insurance regulations not implemented in BMTs in\r\nthe former Surakarta Residency, which serve as nazhir for cash waqf?\r\nSecond, how do BMTs accept the idea of cash waqf? Third, how is the\r\nconstruction and reconstruction of cash waqf protection in BMTs?\r\nThis research is a field study with a sociological approach. The\r\nBMT served as the research site. Data were obtained through interviews,\r\ndocumentation, and observation. Data sources included BMT\r\nadministrators and BMT managers, the Head of PBMTI (Indonesian\r\nIslamic Waqf Association) for the 2010-2020 period, and Waqf\r\nOrganizers from the Ministry of Religious Affairs and the Indonesian\r\nMuslim Association (BWI). Data were analyzed using interactive\r\ntechniques including data reduction, data presentation, and conclusion\r\ndrawing. Solo Raya was chosen because this region has a significant\r\nnumber of national BMT figures, and a significant number of BMTs\r\nserving as cash waqf administrators, compared to the national average.\r\nThis research shows that the ineffectiveness of cash waqf\r\ncertification and insurance regulations is due to several factors, namely a\r\nlack of guidance and supervision, problems with legal certainty and\r\nIslamic jurisprudence, practical habits, and the absence of social pressure.\r\nHowever, despite their formal non-compliance, BMTs are functionally\r\ncompliant by performing protection functions through administrative\r\ninstruments and risk mitigation. Existing protections need to be\r\nreconstructed so that BMT compliance is not only functional but also\r\nformal. Therefore, a dualism model of compliance, which is novel in this\r\nresearch, is needed through strengthening the role of the state and\r\nstrengthening BMT internal facilities."^^ .
