This issue arises from the development of modern social life in which many wives participate in employment and even become the primary breadwinners of the family. Such conditions have led to differences of opinion among Islamic scholars regarding the position and responsibility of wives in fulfilling family financial support. This research aims to examine the views of Ibnu Hazm and Yusuf al-Qaradawi concerning family support from the wife’s wealth and to analyze their differences using the approach of maṣlaḥah.&#13;
This research employs a normative legal research method with a descriptive-comparative approach. Primary data sources were obtained from the works of Ibnu Hazm, namely Al-Muhallā and Al-Iḥkām fī Uṣūl al-Aḥkām, as well as Yusuf al-Qaradhawi’s Contemporary Fatwas. Secondary data were collected from books, journals, and other literature related to Islamic family law and financial support. The data were analyzed through description, comparison, and legal analysis using theory of maṣlaḥah.&#13;
The results of this study show that Ibnu Hazm argues that a wife may bear the family’s financial responsibility when the husband is unable to fulfill his obligation, and such support is not considered a debt that must later be repaid by the husband. This view is based on the principle of capability and the flexibility of Islamic law in maintaining family welfare. Meanwhile, Yusuf al-Qaradhawi maintains that the obligation of financial support remains the responsibility of the husband, while the wife’s contribution to family expenses is voluntary and regarded as an act of mutual assistance and kindness. These differences are influenced by their methods of legal reasoning, social conditions, and approaches to Islamic legal thought.&#13;
Based on the analysis of maṣlaḥah, both views share the same objective, namely preserving the welfare and harmony of the family. However, Yusuf al-Qaradawi’s opinion is considered more relevant as a general principle in modern family life because it maintains the husband’s responsibility for financial support while still allowing economic cooperation within the household.
