These loopholes include the unexecuted processes of inheritance transfer and name change on certificates, transactions based solely on village seal letters, and fractional ownership without official certificate splitting at the Land Office. This practice raises main issues regarding the legal certainty of land rights for good-faith buyers in such transactions and the forms of legal protection that can be provided to the parties. The research method applied is normative-empirical legal research using a normative juridical approach combined with a sociological-empirical approach. The research data sources comprise primary data obtained through in-depth interviews with transacting parties and village officials, as well as secondary data from literature studies of legislation and legal literature. The theoretical framework proposed to analyze this issue encompasses the Theory of Legal Certainty by Gustav Radbruch and land registration, the Theory of Sale and Purchase Agreement based on Article 1320 of the Civil Code and customary law, and the Theory of Legal Protection by Satjipto Rahardjo and Philipus M. Hadjon. The results show that customary sale and purchase of inherited land in Tanjunganom Village fulfills customary law validity through the principles of openness and cash payment (terang dan tunai) and satisfies civil agreement requirements, yet fails to provide complete legal certainty under national land law due to the lack of official land registration. Preventive legal protection can be achieved through inheritance transfer registration, name change, and making a Sale and Purchase Deed before a Land Deed Official (PPAT).
