"This research is motivated by the rise of extortion crimes using the Cash on Delivery (COD) transaction modus operandi via social media, accompanied by threats using sharp weapons by the Defendant (D.R.S). In Case Decision Number 176/Pid.B/2025/PN Yyk, the Public Prosecutor compiled an alternative indictment based on Article 368 paragraph (1) of the Criminal Code and Article 378 of the Criminal Code, demanding a prison sentence of 1 year and 6 months before the Panel of Judges ultimately rendered a verdict of 1 year imprisonment. Based on this background, this study formulates research problems regarding the grounds for the Public Prosecutor's consideration in conducting prosecution and how the implementation of the Public Prosecutor's authority is executed in the extortion crime case at the Yogyakarta District Attorney's Office.\r\nThis type of research is empirical legal research (juridical-empirical) with an analytical descriptive nature, focusing on systematic data presentation. Primary data sources were obtained through direct interviews with Functional Prosecutors at the Yogyakarta District Attorney's Office, while secondary data were obtained from legal document studies, case files, and related literature. Data collection methods were carried out through interviews and literature studies, which were then qualitatively analyzed using the framework of Legal Consideration Theory and the Dominus Litis Theory.\r\nThe results of the study conclude that: First, the grounds for the Public Prosecutor's consideration in conducting the prosecution encompass both juridical and non-juridical aspects. Juridical considerations are based on the fulfillment of all elements of Article 368 paragraph (1) of the Criminal Code, the concurrence of valid evidence and physical evidence in the form of a sickle and a mobile phone (interlocking evidence), and the absence of excusable or justifying defenses for the defendant. Non-juridical considerations include the COD trap modus operandi, the real threat of sharp weapons to the victim's life and psychological well-being, as well as aggravating and mitigating circumstances. Second, the implementation of the Public Prosecutor's authority reflects the principle of Dominus Litis independently and professionally. This is demonstrated through case control from the pre-prosecution stage, drafting alternative indictments to anticipate evidentiary dynamics in court, reading the prosecution claim (requisitoir), to executing the judges' decision that has attained final legal force (inkracht van gewijsde)."^^ .
