concerning the Management of Abandoned Areas and Land, with a case study in
Karangasem, Bali. Abandoned land represents a major agrarian issue that leads to
inequality in land tenure, obstruction of spatial utilization, and a decline in the
social function of land as mandated by the Basic Agrarian Law. The existence of
land that is not utilized in accordance with the purposes for which the rights were
granted not only causes losses for the rights holders, but also hinders efforts to
equalize access and utilization of agrarian resources for the community. Through
Government Regulation No. 48 of 2025, the government attempts to strengthen the
mechanisms of oversight, identification, management, and designation of
abandoned land to ensure legal certainty and optimize land utilization for the
public interest.
The research method applied is empirical legal research using a statutory
approach and a case approach. Data were obtained through literature studies,
interviews, and documentation related to the management of abandoned land in the
Karangasem region, Bali. Qualitative analysis was conducted to determine the
effectiveness of law enforcement against abandoned land and the obstacles
encountered in its implementation.
The results indicate that the implementation of law enforcement against
abandoned land in Karangasem has not run optimally. This is caused by several
factors, including a lack of oversight, weak inter-agency coordination, low
awareness among right-holders regarding land utilization obligations, as well as
administrative and social constraints within the community. Nevertheless, the
enactment of Government Regulation No. 48 of 2025 provides a firmer legal basis
for the identification and management process of abandoned land. Therefore, it is
necessary to enhance monitoring, integrate real-time land data, and strengthen
synergy between the central and regional governments so that law enforcement
against abandoned land can operate effectively and provide benefits to the
community.</mods:abstract><mods:classification authority="lcc">346.043 8 Hukum Agraria/ Pertanahan</mods:classification><mods:originInfo><mods:dateIssued encoding="iso8061">2026-08-13</mods:dateIssued></mods:originInfo><mods:originInfo><mods:publisher>UIN SUNAN KALIJAGA YOGYAKARTA;FAKULTAS SYARIAH DAN HUKUM</mods:publisher></mods:originInfo><mods:genre>Thesis</mods:genre></mods:mods>
