Despite their legal status as preferred creditors, workers' rights frequently conflict with the execution rights of secured creditors, causing severe legal uncertainty. This disparity is evident in the bankruptcy cases of PT Sri Rejeki Isman Tbk (Sritex), PT Prakarsa Semesta Alam, and PT Arpeni Pratama Ocean Line Tbk. Consequently, this research addresses two main questions: (1) the legal position and protection of workers' economic rights across these three cases post-homologation annulment; and (2) the analysis of such protection through Gustav Radbruch's Theory of Legal Ideals and Ibn Ashur's Maqasid al-Shariah. This study employs normative legal research with statutory, conceptual, and case approaches, utilizing qualitative analysis and deductive reasoning. The analytical framework integrates Radbruch's core values (justice, legal certainty, and utility) with Ibn Ashur's Maqasid al-Shariah principles (public welfare, preservation of social order, and equitable wealth circulation). The findings reveal that although Constitutional Court Decision No. 67/PUUXI/ 2013 normatively recognizes workers' rights, practical protection remains ineffective due to the dominance of secured creditors and insufficient debtor assets. From Radbruch's perspective, the current bankruptcy system fails to achieve a balanced realization of justice, certainty, and utility for workers. Similarly, from Ibn Ashur's lens, the framework has not fully accomplished public welfare and equitable wealth distribution. Accordingly, this study recommends harmonizing Law No. 37 of 2004 with the Constitutional Court framework, establishing a mandatory workers' reserve fund prior to asset liquidation, and strengthening the curator's authority to prioritize workers' payments independently of secured creditors' collateral execution. %Z Dr. H.
