      "abstract": "This research is motivated by the issue of proving marriage in Decision Number 6558\/Pdt.G\/2025\/PA.Kab.Mlg, in which the parties’ marriage had been registered at the Office of Religious Affairs (KUA) of Kalipare District, but the Marriage Certificate (Kutipan Akta Nikah) could not be presented by the Applicant because it was in the possession of the Respondent. This condition raises an issue concerning the application of Article 7 of the Compilation of Islamic Law (KHI), which provides that a marriage can only be proven by a Marriage Certificate and provides a mechanism for marriage validation (isbat nikah) when a marriage cannot be proven by a Marriage Certificate. In this case, the Panel of Judges did not terminate the evidentiary process or direct the Applicant to pursue isbat nikah, but instead examined the Marriage Register Book brought by the KUA officer as part of the evidence. This research aims to examine the representation of Article 7 of the KHI in the judges’ considerations concerning the proof of marriage based on progressive law.\r\nThis research is a library research with a descriptive-analytical nature, using a sociological approach and a case study strategy. The primary data source is Decision Number 6558\/Pdt.G\/2025\/PA.Kab.Mlg, supported by interview data, while the secondary data sources consist of legislation, books, journals, and other relevant literature. The data were analyzed qualitatively by describing and analyzing the judges’ considerations and steps in the process of proving the marriage.\r\nThe results of the research show that the representation of Article 7 of the KHI in the decision is reflected in the interpretation that the inability to present the Marriage Certificate does not automatically indicate the absence of evidence of the marriage. The parties’ marriage had been registered at the KUA, and the existence of the Marriage Certificate could be verified through the Marriage Register Book. The Marriage Register Book brought by the KUA officer was compared with the photocopy submitted as evidence and was considered to fulfill the formal and material requirements of an authentic deed, with perfect and binding evidentiary force. From the perspective of progressive law, the judges’ steps did not stop at the formal issue but sought to establish the truth of the parties’ legal relationship and achieve substantive justice while maintaining verification of the available evidence.",
