"Circular Letter of the Director General of Islamic Community Guidance No. P-005/DJ.III/Hk.00.7/10/2021 was issued by the Ministry of Religious Affair of the Republic Indonesia, specifically the Directorate General of Islamic Community Guidance, as follow-up to the Circular Letter of Binbaga Islam No. D.IV/Ed/17/1979 concerning Polygamy during the Iddah Period, which was no longer effective. Given the relatively high divorce rate in Gunungkidul Regency and the high number of divorced men, applications for new marriages with another woman before the expiration of the ex-wife’s iddah period have become possibility. The main issues in this study are the opinions of Religious Affairs Offices (KUA) across Gunungkidul Regency regarding the policy of the Circular Letter from the perspective of maqashid syari’ah, as well as their responses to applications for new marriages before ex-wife’s iddah period expires. This study aims to measure the effectiveness of the Circular Letter as a legal basis regarding the issue of marriage during the iddah period.\r\nThis study is a descriptive-analytical field research employing a normative-empirical approach. Data was collected through in-depth interviews with KUA officials across Gunungkidul Regency, documentation, and document studies. The theoretical framework used for analysis is the perspective of maqashid syari’ah, which is grounded in its five essential pillars of preservation. The analysis was conducted by relating the KUA’s opinions on the public interest (maslahah) embedded in the Circular Latter to the core elements of maqashid syari’ah.\r\nThe results indicate that the majority if KUA in Gunungkidul Regency fully support the Ministry of Religious Affairs’ policy in the circular letter and adopt it as a legal basis. In response to marriage applications made during the ex-wife’s iddah period, the KUA requires the applicant to wait until the ex-wife’s iddah period has elapsed. However, regarding the circumstances, some KUA still take urgency reasons into consideration, while others suggest applying for court as an alternative solution."^^ . "2026-08-13" . . . .
