The act is not formulated as a distinct criminal offense under Indonesian legislation; therefore, its legal classification and sanctions depend on the elements and circumstances of the conduct. This study aims to describe criminal sanctions for perpetrators of breast groping under Indonesian positive criminal law and Islamic criminal law and to analyze their sentencing rationale through the perspectives of Barda Nawawi Arief and Ocktoberrinsyah. This study employs normative legal research using statutory, conceptual, and comparative approaches. The primary legal materials consist of Law Number 1 of 2023 on the Criminal Code, Law Number 12 of 2022 on Sexual Violence Crimes, and Law Number 1 of 2026 on Criminal Adjustment. The materials were collected through library research and analyzed qualitatively using a descriptiveanalytical method. Positive criminal law is analyzed through Barda Nawawi Arief's framework of criminal law policy and sentencing, while Islamic criminal law is examined through Ocktoberrinsyah's purposes of punishment: al-jaza', az-zajr, alislah, al-isti'adah, and at-takfir. The findings show that breast groping is not formulated as a distinct criminal offense; therefore, its legal classification depends on the characteristics and specific elements of the conduct. Under Indonesian positive criminal law, Article 414 of the Criminal Code has stronger relevance, particularly Article 414 paragraph (1) letter b where the act is committed forcibly through violence or threats of violence. Where these elements are not fulfilled, Article 414 paragraph (1) letter a of the Criminal Code or Article 6 letter a of the Sexual Violence Crimes Law may remain applicable, provided that all elements of the respective provisions are satisfied. Positive criminal law also provides sentence enhancement, additional penalties, offender rehabilitation, restitution, and victim recovery. Under Islamic criminal law, breast groping is more appropriately classified as a jarimah ta'zir because it does not fall within the construction of hudud or qisas-diyat. The type and degree of uqubah may be adjusted to the seriousness of the offense but must remain subject to justice, public benefit, and the protection of honor (hifzh al-'irdh).
