The people of Padang Sawah are Muslims while at the same time continuing to observe customary rules governing kinship and marriage. This situation raises two main issues: the factors underlying the prohibition of intra-clan marriage and the legal position of the prohibition from the perspectives of customary law and Islamic law. This study is field research using an empirical legal approach and is supported by library research. It is descriptive-comparative in nature. Primary data were obtained through interviews with four clan chiefs, namely the chiefs of the Patopang, Melayu, Domo, and Peliang clans, as well as Ustadz Asben, S.Pd.I., the Imam Malin of Padang Sawah Village. Data were also collected through observation and documentation, while secondary data were drawn from the Qur’an, Hadith, books, scholarly journals, statutory regulations, and other academic works related to customary law, Islamic marriage law, and Maṣlaḥah Mursalah. The data were analyzed comparatively by relating field findings to customary law and Islamic law. The findings show that the prohibition of intra-clan marriage does not arise from a single factor. It is associated with historical-genealogical inheritance from the ancestors, the matrilineal kinship system and the principle of exogamy, social acceptance, and customary sanctions that reinforce compliance. From the perspective of customary law, the prohibition constitutes an internally binding norm because members of the same clan are regarded as belonging to one kinship circle. Violations may result in a buffalo fine, social sanctions, Sumpah Sotih, expulsion, or a clan-transfer mechanism, depending on the rules of each clan. From the perspective of Islamic law, belonging to the same clan does not in itself create a mahram relationship or render a marriage unlawful. The customary prohibition may be maintained as a social norm insofar as it provides benefits for preserving kinship structures and social order, but it cannot be used to create a new category of mahram or prohibition that is not established by Islamic law.</mods:abstract><mods:classification authority="lcc">340.57 Hukum Adat - Indonesia</mods:classification><mods:originInfo><mods:dateIssued encoding="iso8061">2026-08-03</mods:dateIssued></mods:originInfo><mods:originInfo><mods:publisher>UIN SUNAN KALIJAGA YOGYAKARTA;FAKULTAS SYARIAH DAN HUKUM</mods:publisher></mods:originInfo><mods:genre>Thesis</mods:genre></mods:mods>
