beings and remains a subject of differing opinions among Islamic scholars. The
development of visual technology has resulted in various new forms of
representation, including animation and animation generated through Artificial
Intelligence (A.I.) technology. This development raises questions regarding the
legal status of Taṣwīr in animation and A.I.-generated animation from the
perspective of Islamic law. This study examines the legal status of Taṣwīr in
animation and A.I.-generated animation and compares it with Fatwa Al-Lajnah Ad-
Dā’imah No. 2036 and Fatwa Majlis Al-Iftā’ Al-A‘lā Al-Filasṭīnī No. 724 in
determining their legal foundations and status.
This research is a normative legal study employing a descriptive-analyticalcomparative
method with a normative approach. The primary sources of this
research are Fatwa Al-Lajnah Ad-Dā’imah No. 2036 and Fatwa Majlis Al-Iftā’ Al-
A‘lā Al-Filasṭīnī No. 724, while the secondary sources consist of works on uṣūl alfiqh,
books, journals, and other relevant literature. Data were collected through
documentation and analyzed qualitatively. The analysis employs the theories of
Sadd Aż-Żarī‘ah, Fatḥ Aż-Żarī‘ah, and comparative law to examine the legal
considerations and differences in the construction of legal rulings concerning
Taṣwīr in animation and A.I.-generated animation.
The results of the study show that Taṣwīr in the form of animation and A.I.-
based animation is conditionally permissible, depending on its purpose, manner of
use, and consequences. Its use that leads to maṣlaḥah and does not contradict
Islamic law falls within the scope of Fatḥ Aż-Żarī‘ah, while its use that leads to
mafsadah falls within the scope of Sadd Aż-Żarī‘ah. The comparative analysis
shows differences between the two fatwas. Al-Lajnah Ad-Dā’imah establishes the
prohibition of Taṣwīr of living beings, whereas Majlis Al-Iftā’ Al-A‘lā Al-Filasṭīnī
permits animation subject to certain conditions. This research shares common
ground with the approach of Majlis Al-Iftā’ Al-A‘lā Al-Filasṭīnī in providing room
for the permissibility of animation; however, such permissibility is understood
conditionally based on its purpose, use, and consequences. Furthermore, A.I.
technology itself does not constitute an independent determining factor in the legal
ruling; rather, its legal status is determined by the purpose and consequences of its
use.</mods:abstract><mods:classification authority="lcc">340.2 Hukum Perbandingan</mods:classification><mods:originInfo><mods:dateIssued encoding="iso8061">2026-08-18</mods:dateIssued></mods:originInfo><mods:originInfo><mods:publisher>UIN SUNAN KALIJAGA YOGYAKARTA;FAKULTAS SYARIAH DAN HUKUM</mods:publisher></mods:originInfo><mods:genre>Thesis</mods:genre></mods:mods>
