However, Circular\r\nLetter No. P-005\/DJ.III\/HK.00.7\/10\/2021 from the Director\r\nGeneral of Islamic Community Guidance actually prohibits men\r\nfrom marrying while their ex-wives are still in their iddah period.\r\nThe tension between classical fiqh principles and this\r\nadministrative policy raises an academic question regarding how\r\nheads of the KUA (Religious Affairs Office) interpret and address\r\nthis provision in the practice of marriage services. Banyumas\r\nRegency was selected as the research site based on previous\r\nresearch indicating that, while KUA heads in Banyumas Regency\r\npreviously held diverse attitudes, there has recently been a shift\r\ntoward uniformity in their attitudes, albeit with varying\r\ninterpretations. This study aims to analyze the interpretations of\r\nKUA heads in Banyumas Regency regarding the prohibition on\r\nmen marrying during their ex-wives’ iddah period and to explain\r\nhow these interpretations influence their attitudes toward\r\nimplementing the policy.\r\nThis study is a qualitative study using a socio-legal\r\napproach. Primary data were collected through in-depth\r\ninterviews with nine heads of the Religious Affairs Offices (KUA)\r\nin Banyumas Regency and the Chair of the Banyumas Chapter of\r\nthe Association of Islamic Marriage Officiants of the Republic of\r\nIndonesia (APRI). Secondary data were obtained from laws and\r\nregulations, circular letters from the Director General of Islamic\r\nCommunity Guidance, academic literature, and previous\r\nresearch. Data were analyzed through data reduction,\r\nclassification, and interpretation. The data were then analyzed\r\nusing Paulo Freire’s theory of consciousness and Max Weber’s\r\ntheory of social action. Paulo Freire’s theory of consciousness\r\nwas used to assess the level of consciousness of the KUA heads,\r\nwhile Max Weber’s theory of social action was used to explain the\r\norientation of the actions underlying their attitudes.\r\nThe results of the study show that the understanding of\r\nKUA heads falls into two categories of awareness: naive\r\nawareness and critical awareness. Naive awareness is based on\r\nregulations, leadership directives, and administrative uniformity.\r\nCritical awareness views policy as an instrument for the\r\nprotection of women, the public good, justice, and the prevention\r\nof covert polygamy. This understanding influences the attitudes\r\nof KUA heads: an understanding based on naive awareness tends\r\nto give rise to an attitude of instrumental rationality, whereas a\r\ncritical understanding tends to give rise to an attitude of valuebased\r\nrationality.
