bibo:abstract "Regulations regarding the right to recall members of the\r\nHouse of Representatives (DPR) in Indonesia continue to place\r\npolitical parties as the primary authority in the Interim Replacement\r\n(PAW) mechanism. These provisions are set forth in Law No. 17 of\r\n2014 on the People’s Consultative Assembly (MPR), the House of\r\nRepresentatives (DPR), the Regional Representatives Council (DPD),\r\nand Regional People’s Representative Councils (DPRD); Law No. 7\r\nof 2017 on General Elections; and Law No. 2 of 2011 on Political\r\nParties, which grant political parties the right to propose the removal\r\nof DPR members. The recall mechanism is more frequently used as\r\nan instrument of internal oversight and control within political parties\r\nrather than as a mechanism for political accountability to the people\r\nas the grantors of the mandate. This situation has the potential to\r\ncreate a conflict with the principle of popular sovereignty as affirmed\r\nin Article 1, paragraph (2) of the 1945 Constitution. Based on these\r\nissues, this study aims to critically examine the existence of the right\r\nof recall from the perspective of popular sovereignty and to formulate\r\na framework for the right of recall from the perspective of Siyāsah\r\nDustūriyyah.\r\nThis study employs a normative legal research method,\r\napplying both the statutory approach and the conceptual approach.\r\nResearch data were obtained through a literature review drawing on\r\nprimary and secondary legal sources. Subsequently, all data were\r\nanalyzed using qualitative descriptive methods, specifically content\r\nanalysis, to examine, interpret, and draw conclusions regarding the\r\nlegal issues under study.\r\nThe research findings indicate that: First, the mechanism for\r\nrecalling members of the House of Representatives (DPR) in\r\nIndonesia still positions political parties as the dominant party, as\r\nstipulated in Article 239 of the MD3 Law, thus reflecting “party\r\nrecall” rather than “constituent recall.” This situation does not yet\r\nfully reflect the principle of popular sovereignty because constituents,\r\nas the grantors of the mandate, do not yet have sufficient say in the\r\nprocess of revoking that mandate; consequently, there is a risk that\r\nthe accountability of DPR members may shift from the people to political parties. The right of recall remains necessary as an\r\ninstrument of oversight and accountability for DPR members. Second,\r\nthe recall mechanism from a constitutional perspective is not intended\r\nto eliminate the authority of political parties, but rather to establish a\r\nbalanced distribution of authority: political parties initiate the recall\r\nprocess, legal mechanisms conduct the review, and the people\r\ndetermine the revocation of the mandate through a vote. This formula\r\nis considered to better reflect the sovereignty of the people and is\r\ncapable of realizing the public interest in the form of political\r\noversight and accountability, while simultaneously preventing harm\r\nin the form of abuse of authority, domination by party elites, and\r\ndisregard for the will of the people."^^xsd:string;
