Kafaah is understood as one of the considerations in choosing a life partner, while lusan is a tradition that prohibits certain marriages based on the order of children in the family. The existence of both shows the interaction between Islamic values and local traditions in marriage practices among the pesantren community. This study aims to examine why the lusan tradition is still maintained and practiced and how the community understands lusan in relation to the concept of kafaah.
This research is a field study using a sociology of law approach and a descriptive-analytical qualitative method. The data were collected through observation, interviews, and documentation involving religious leaders, community leaders, officials of the Office of Religious Affairs (KUA), academics, people who practice the lusan tradition, and members of the pesantren community in Mlarak District. The data were analyzed using the Miles and Huberman model through data reduction, data presentation, and drawing conclusions. The social construction theory of Peter L. Berger and Thomas Luckmann and the perspective of ‘urf were used to analyze the research findings.
The results show that the lusan tradition is still maintained because it is passed down from generation to generation, is still believed in and respected by some members of the community, and can be adjusted in marriage practices. Based on Berger and Luckmann’s social construction theory, the continuity of lusan is formed through externalization in the transmission and practice of the tradition, objectivation through its acceptance as a social reality, and internalization through family, pesantren education, and community experiences. The community’s understanding of kafaah and lusan can be seen in three forms. First, both are considered together in choosing a marriage partner. Second, kafaah is given greater importance, while lusan is still respected as a tradition. Third, kafaah becomes the main consideration, while lusan increasingly depends on individual belief. From the perspective of ‘urf, the lusan tradition can be considered ‘urf shahih when it is treated only as a cultural consideration and is not believed to determine whether a marriage is valid or invalid. Thus, the pesantren community does not simply accept or reject lusan, but adjusts the tradition with kafaah and Islamic values.</mods:abstract><mods:classification authority="lcc">346.01 Hukum Keluarga - Hukum Pernikahan</mods:classification><mods:originInfo><mods:dateIssued encoding="iso8061">2026-08-20</mods:dateIssued></mods:originInfo><mods:originInfo><mods:publisher>UIN SUNAN KALIJAGA YOGYAKARTA;FAKULTAS SYARIAH DAN HUKUM</mods:publisher></mods:originInfo><mods:genre>Thesis</mods:genre></mods:mods>
